New York father faces drug and child endangerment charges

It is one thing to face drug charges in New York, but it is another thing altogether to be charged with drug crimes while in the presence of minors. With that issue in mind, readers of this blog may be interested in a case involving two men arrested by Albany city police on drug possession charges. According to reports, one of the men allegedly had his 4-year-old daughter in the vehicle with him when the arrest took place.

Police claim to have found rock cocaine on a 40-year-old man from Watervliet, as well as on a 35-year-old Albany man. Police were investigating possible drug activity on North Swan and Second Street when the arrest occurred. Reportedly, the men were sitting inside a parked car with the 4-year-old in the back seat. Officers allege that they found a glass tube with rock cocaine in it, as well as 1.6 grams of rock cocaine on one suspect and 0.3 grams on the other.

Police charged one man with third-degree criminal possession of a stimulant and criminal possession of a narcotic, fifth-degree criminal possession of a controlled substance and loitering. The other man was charged with seventh-degree criminal possession of a controlled substance, loitering and endangering the welfare of a child. The man's daughter was turned over to family members, and Child Protective Services was notified.

Indeed, facing drug charges can be intimidating, especially when a minor is present during the arrest. But no matter the nature of a charge, it is of the utmost importance that the rights of individuals accused of a crime are aggressively protected. Everyone has certain protections under the law, and when children are allegedly involved in a crime, too often courts are swayed toward undue punishment. That is why individuals accused of drug crimes should know their rights. Every possible approach should be considered, and every aspect of an investigation or arrest should be closely scrutinized to ensure that New Yorkers' rights are upheld in court.
