New York town mayor faces DWI charge


American justice holds that no one is above the law. That lesson is apparent to any New Yorker who followed the recent news about the latest arrest of Monticello Mayor Gordon Jenkins. The mayor landed in trouble with police when he was caught in the aftermath of an apparent drunken-driving accident. He then compounded his problem with a series of profanity-laden rants directed at officers that were caught on police surveillance videos.

Police arrested Jenkins after a volunteer firefighter noticed that he appeared drunk after arriving on scene at a car accident. Police took him to a police station interview room and cuffed one hand to a wall. The surveillance video taken in the room clearly shows Jenkins using vulgar language and insults in describing various police officers. At one point, Jenkins ripped a clock from the wall and hurled it outside the room. Yet, no matter one's reaction to an arrest, he is innocent until proven guilty.

Jenkins now faces charges of criminal mischief, obstruction of justice, refusal to take a breath test and drunken driving. A citizens' group is asking him to step down.

In this case, it is not evident in the surveillance video that Jenkins was intoxicated. However, if he is convicted on the charges, he will face serious repercussions, including a badly damaged reputation.

Driving while intoxicated is a serious traffic offense that can profoundly affect a person's career, driving privileges and freedom, if only temporarily. A DWI conviction can result in a prison sentence, fines and the automatic suspension of a driver's license. Fortunately, like any other charge, DWI is a one that can be challenged by a qualified and experienced legal professional who very often can find a way to avoid the harshest penalties of a conviction.
